Terms and Conditions

These general conditions of sale govern the terms and conditions of sale of the products marketed by Lucia Maria Monterosso – Pannolinofelice.
All contracts for the online sale of products by Pannolinofelice to third parties (the “Customers”) in Italy are governed by these General Conditions, which form an integral and essential part of every proposal, order and purchase order confirmation of Products themselves.
The conditions of sale applicable to your order are those in force on the date of the order.

Products: prices and features

All product prices published by Pannolinofelice must be understood as inclusive of VAT. The prices of the Products published from time to time by Pannolinofelice cancel and replace the previous ones and are subject to the actual availability of the Products. Pannolinofelice reserves the right to confirm or modify the prices of the Products published on its website or in information brochures and advertising material, upon confirmation of the Customer’s order.

The technical and functional characteristics relating to the Products published by Lucia Maria Monterosso – Pannolinofelice through its own promotional messages and information brochures are those communicated by the respective manufacturers. Pannolinofelice assumes no responsibility for the truthfulness and completeness of such information. The images of the products are indicative and not binding.

Although Pannolinofelice can provide information on the characteristics of the Products, the Customer is responsible for the choice of the Products ordered and for the correspondence and conformity of the specifications indicated by each manufacturer to their needs.

Orders and shipments in Italy

All purchase orders for Products sent to Pannolinofelice must be complete in all their parts and must contain all the elements necessary for the correct identification of the Products ordered. Each order of Products sent to Pannolinofelice constitutes the Customer’s contractual proposal and, therefore, will be binding for Pannolinofelice only if confirmed by it for acceptance. The fulfillment of the order by Pannolinofelice is equivalent to confirmation and acceptance of the same. The order will be confirmed and processed as soon as possible, and in any case within 2 business days.

Delivery costs by courier in Italy are € 7.90, except for special offers or conditions, and free of charge over € 95 of expenditure. Depending on the payment method chosen, Pannolinofelice may request a collection fee as specified below: € 4.00 for the cash on delivery service (cash payment to the courier upon delivery), 1.5% of the order amount for payment by Paypal / credit card, no charges for payment by bank transfer and Satispay, no charges for payment in cash or debit card for delivery in Cremona.

If you want to buy a single product with a maximum cost of € 20, you can use the discount code S590 to have shipping at the reduced rate of € 5.90 instead of € 7.90.

Pannolinofelice reserves the right to cancel orders placed and not paid after 3 days from the date of the order. In case of non-execution of the order (if the same is due to unavailability of the Products ordered by the Customer or for reasons of force majeure), Pannolinofelice will as soon as possible inform the Customer, reimbursing any sums already paid by them in the supply not performed. In this case, the Customer will not be entitled to any reimbursement or indemnity or compensation of any kind.

The order will be accompanied by a paper summary valid as a transport document and order confirmation. According to current legislation, it is not necessary to add a receipt to the products purchased online, if you wish to receive a tax invoice to be presented for any refunds, it is necessary to request it explicitly by writing to pannolinofelice@hotmail.it.

Delivery of Products and payments

The delivery terms indicated by Pannolinofelice refer to the Products present in its warehouses and, although carefully evaluated, must be understood as non-binding for Pannolinofelice, which can subsequently confirm or modify them, according to its actual needs. Any delays in deliveries of less than 30 (thirty) days do not entitle the Customer to refuse delivery of the Products, nor to claim compensation or indemnities of any kind.

For the delivery of the package by SDA / Poste Italiane courier, two delivery attempts are made: in case of absence, a notice is left with directions to arrange a subsequent delivery. After the order you will be updated on the shipping times and you will receive an email the day the package will be delivered or the tracking code if you have chosen to pay cash on delivery. If you are not sure if you are at home, you can choose to have the package delivered to the post office closest to your home, at no additional cost: you will be notified by email and text message when the package is ready to be collected. If you want to activate this service or have other particular information to provide to facilitate delivery, write them in the space provided on the Shopping Cart page (for example timetables, directions…).

Upon delivery of the goods by the courier, the Customer is required to check that the packaging is intact, not damaged, or otherwise altered. The existence of any damage must be immediately reported to the courier by making a note on the delivery note. It is understood that in the event of no dispute, the Customer accepts the goods delivered to him. It should be noted that the packaging cardboard of the orders are recycled and therefore may have printed writings not corresponding to the contents of the package; a waybill is always attached to the package with the sender clearly marked “Pannolinofelice”, while for privacy reasons the contents of the package are not indicated.

The goods travel at the risk of the receiver even if sold carriage paid. Any problems concerning the integrity, correspondence or completeness of the products received must be reported within 24 hours of delivery by e-mail to the address pannolinofelice@hotmail.it. In case of non-collection within the terms indicated by the courier of the material in storage at the courier’s warehouses resulting from the impossibility of delivery to the address indicated by the Customer, the purchase order will be automatically canceled. If the Customer expresses the desire to receive the goods again, the shipping costs will be entirely at his expense (those of return due to storage and those of new shipment).
Special terms and conditions of delivery must be agreed in advance between the customer and Pannolinofelice and accepted in writing by Pannolinofelice.

Generally and barring unforeseen circumstances, the delivery of the order to the receiver takes place within 2/3 days throughout Italy, in northern Italy normally within 24 hours of shipment. Delivery times may vary from one product to another: any variations are indicated in the product sheet. Orders are normally processed within 24 hours on business days; delivery is intended as the date of departure from our warehouses and not the date of arrival. You can request Express Delivery in 24h (considering business days) at a cost of € 8.50 for any amount of the order: the package will be prepared as soon as possible (generally the day after the order) and will be delivered the day after the shipment. We do not deliver on Saturdays, except in some areas where the Saturday delivery service is active.

Although Pannolinofelice does everything possible to respect the delivery agreements, it is not responsible for any shipments delivered late with respect to the times indicated, due to delays by the courier, for example if the courier does not come to collect the package on the agreed day or takes longer to deliver than Express shipping. This can especially happen in late December and in July and August.

The payment by customers can be made by credit card, PayPal, bank transfer, Satispay and cash on delivery.

Shipping to Europe

​Shipments are also made to European countries; delivery by courier is expected in approximately 3/7 working days. All shipments are traceable on the SDA courier website. These are the rates:

Shipping to Austria, Belgium, Denmark, Germany, Luxembourg, Holland, Poland, Czech Republic, Slovakia, Slovenia, Hungary:  € 15,75.

Shipping to France, Spain: € 18,91.

Shipping to Croatia, Estonia, Finland, Greece, Ireland, Latvia, Lithuania, Malta, Portugal, Romania, Sweden: € 20,25.

The payment of the order can be done by bank transfer, credit card or Paypal account. For shipments to Europe, free delivery is provided for minimum orders of € 200 and by payment by bank transfer, to be requested after confirming the order and before making the payment.

​Special offers and gifts

Any special offers promoted by Pannolinofelice are valid until stocks are exhausted and, in any case, are subject to the actual availability of the relevant Products in the cloth of Pannolinofelice.
If a special offer promoted by Pannolinofelice provides for the sending of a free product together with one or more products purchased, the customer will be entitled to this free product until stocks are exhausted.
No assistance or replacement is provided in relation to any products received free of charge by the Customer.

Product Warranties – Technical assistance

If you find any problems or irregularities after purchase and during the warranty period, we are at your disposal to help you, provided that the warranty is the responsibility of the relevant manufacturers.

Right of withdrawal

Purchases made on our commercial premises are protected by Legislative Decree no. 185 of 22 May 1999 and by Legislative Decree no. 21/2014, which provides for the possibility for the consumer to exercise the right of withdrawal.

The consumer can exercise the right of withdrawal within a period of 14 business days from receipt of the goods (the delivery date is valid). This right consists in the right to return the purchased goods to the supplier without any penalty and without specifying the reason, and in the consequent refund of the purchase price. The consumer can exercise the right of withdrawal by means of a written declaration sent by e-mail to the address pannolinofelice@hotmail.it or by registered letter with return receipt or by certified e-mail (luciamonterosso@pec.it) and with the simultaneous return of the products within 14 business days at Pannolinofelice, viale Trento e Trieste 23/e,  26100 Cremona. The products must not have been used or damaged and must be returned intact, in their original packaging, at the customer’s expense. Once we have received the goods and verified their integrity, we will, as soon as possible, credit the customer with the cost of the returned products.

The right of withdrawal applies to natural persons who act for purposes not related to their professional activity. Therefore, purchases made by retailers, companies, holders of VAT numbers are excluded from the right of withdrawal.

Treatment of personal data

Personal data is collected for the purpose of registering the customer and activating the procedures for the execution of the contract and the related necessary communications towards him; these data are processed electronically in compliance with the laws in force and may only be exhibited at the request of the judicial authority or other authorities authorized by law for this purpose. Personal data will be communicated to subjects delegated to carry out the activities necessary for the execution of the stipulated contract and disseminated exclusively for this purpose. The interested party enjoys the rights specified in the current legislation, namely: to ask for confirmation of the existence of their personal data at the headquarters of Lucia Maria Monterosso – Pannolinofelice; to know their origin, the logic and the purposes of their treatment; to obtain its updating, rectification and integration; to request cancellation, transformation into anonymous form or blocking in the event of unlawful processing; to oppose their processing for legitimate reasons or in the case of use of the data for sending advertising material, commercial information, market research, direct sales and interactive commercial communication. Obtaining the cancellation of personal data is subject to sending a written communication sent by registered letter with return receipt (Lucia Maria Monterosso – Pannolinofelice, via Bembo 23, 26100 Cremona -Italia-) or PEC (luciamonterosso@pec.it) and possibly in advance by email (pannolinofelice@hotmail.it).

Obligations of the buyer

These general conditions can be updated or modified at any time by Pannolinofelice simply by publishing them on its own page of the pannolinofelice.com website. The consumer undertakes and agrees to take note of the conditions of sale every time he makes a purchase. It is strictly forbidden for the buyer to enter false, and / or invented, and / or fictional data in the registration procedure necessary to activate the process for the execution of this contract and related further communications for him; the personal data and the e-mail address must be exclusively their real personal data and not those of third parties, or of fantasy. The Customer indemnifies Pannolinofelice from any liability deriving from the issue of incorrect tax documents due to errors relating to the data provided by the Customer, since the Customer himself is solely responsible for the correct insertion.

Competent Court

Without prejudice to the possible applicability of mandatory provisions of law for the protection of consumers (as defined pursuant to Article 1 letter b) of Legislative Decree 22 May 1999 no. 185), any dispute connected to these General Conditions will be devolved to the exclusive jurisdiction of the Court of Cremona. Pursuant to and for the purposes of articles 1341 and 1342 of the civil code, the Customer declares to have carefully read and understood and specifically accept all the clauses of the General Conditions of sale of Lucia Maria Monterosso – Pannolinofelice.
